TERMS AND CONDITIONS – GOING 4 CUZCO

By contracting the services of Going 4 Cuzco, the client expressly accepts the following terms and conditions, which regulate the contractual relationship between the agency and its passengers, in accordance with current Peruvian legislation.

1. AGENCY IDENTIFICATION

In compliance with the duty of information, the details of the service provider company are identified:

2. PURPOSE OF THE CONTRACT

This contract aims to provide organization and operation services for tourism packages in the Cusco region and other locations in Peru. The agency acts as a direct operator or intermediary, as specified in the final itinerary, which constitutes an integral part of the contract.

3. RESERVATIONS AND PAYMENTS
  • To confirm the reservation, a minimum deposit of 30% of the total service value is required. This payment ensures availability and locks in the agreed rates.
  • The remaining balance must be paid in full no later than 48 hours before the start of the tour. For last-minute reservations (less than 48 hours in advance), 100% payment will be required.
  • Accepted payment methods will be communicated to the client, who will assume any bank or payment gateway fees that may be generated.
4. CANCELLATION AND WITHDRAWAL POLICY
  • All cancellation or modification requests must be communicated in writing to the agency's email to be valid.
  • No-shows or cancellations outside the established deadlines will not entitle to any refund, applying a penalty of 100% of the service value.
  • Non-refundable services: Certain services, due to their nature and the policies of final providers, do not allow refunds once purchased. This includes, but is not limited to: airline tickets, train tickets, entrance tickets to Machu Picchu, Huayna Picchu, Rainbow Mountain, and Inca Trail.
  • In case of cancellation by the client, penalties will be applied to cover administrative expenses and penalties imposed by suppliers (hotels, transportation, etc.).
5. MODIFICATIONS BY THE AGENCY

The agency reserves the right to modify itineraries, schedules, or services due to force majeure or acts of God, such as natural disasters, social conflicts, strikes, or adverse weather conditions that put the passenger's safety at risk. In such cases, the agency will offer alternatives of equal or greater value, without this constituting a contractual breach.

6. DOCUMENTATION AND PASSENGER RESPONSIBILITY
  • It is the exclusive responsibility of the passenger to carry valid identity documentation (ID, Passport) necessary for the trip. For IGV (VAT) exemption, foreigners must present their passport and the Andean Migration Card (TAM) with the entry stamp and a stay of no more than 60 days.
  • The passenger declares to be in good health and physically fit for the tour activities. They must inform the agency about any pre-existing medical condition (allergies, illnesses, etc.) that may affect their participation.
  • The passenger commits to follow the guides' instructions and maintain behavior that does not put at risk their integrity or that of the group.
7. LIMITATIONS OF AGENCY LIABILITY

The agency's liability is limited to the organization and execution of the tourism services described in the itinerary. We are not responsible for:

  • Loss, theft, or damage to luggage and personal belongings, which are under the exclusive custody of the passenger.
  • Accidents, injuries, or illnesses that are not the direct result of proven negligence by the agency.
  • Cancellations or delays of flights, trains, or other transportation operated by third parties.
  • Personal decisions of the passenger that lead them to deviate from the program or engage in risk activities not contemplated in the tour.
8. INSURANCE

Our tour packages do not include personal travel insurance. The passenger is strongly encouraged to purchase travel insurance with coverage for accidents, medical emergencies, repatriation, trip cancellation, and baggage loss. The purchase of such insurance is the responsibility of the passenger.

9. CLAIMS BOOK AND DISPUTE RESOLUTION

The agency has a virtual and physical Claims Book available to the client, in compliance with current regulations. Any claim must be submitted through this medium or through our email, detailing the facts and attaching relevant evidence. The agency will respond within the legal period of 15 business days.

10. JURISDICTION AND APPLICABLE LAW

For any controversy that may arise from the interpretation or execution of this contract, the parties expressly submit to the jurisdiction of the judges and courts of the judicial district of Cusco, Peru, waiving any other jurisdiction that may correspond to them. The contract is governed and interpreted in accordance with the laws of the Republic of Peru.
